When determining the amount of the tax and wage penalties, the Commissioner of Revenue may consider any statement made in anticipation or acquiescence of payments due under the Federal or State law, including the statements furnished by the parties to an agreement for wages and/or the statement furnished by the claimant. (d) To ensure compliance with the Federal tax law, IDOL employees shall not make, print, or publish any statement of wage or employment information which the Commissioner determines to be false or misleading. The Commissioner may penalize a person who violates this Subsection by the payment of a civil penalty of 10 per day. Such penalty may be imposed on any person or any partnership or association which makes or publishes any false or misleading statement or representation. “False or misleading statement or representation” means and is deemed to include any statement or representation which fails to disclose any material fact or information with respect to the matters described in this Subsection. The Commissioner may not establish any criteria for civil penalties and may adopt any measure of discretion necessary to carry out the provisions of this Subsection. (e) The Commissioner is authorized to adopt rules and regulations for the administration of this Subsection.
